Scope

This policy applies to Excelia Groupe and its affiliates (“We”, “Us” and “Our”), and describes how we collect, use, and disclose personal information.

This Privacy Policy covers personal information that we collect, use and disclose from our websites, mortgage loan applications and inquiries sent to us. It also covers personal information that we otherwise collect, use, and disclose. The term “personal information” means any information relating to an identifiable individual, subject to more particular definitions or interpretations under applicable laws in effect. Personal information generally includes name, email address and financial information related to a person, but does not generally include contact details or information related to the company.

The present Privacy Policy does not apply to the personal data of employees, of temporary or permanent personnel, consultants or other persons carrying out a mandate with us.  Moreover, the present Privacy Policy does not cover any information that does not constitute “personal information” as defined or interpreted under applicable laws in effect.

Nature of Information Collection

Where applicable, we obtain personal information directly from you or from our interactions with you, but we may also obtain your personal information from other sources, including mortgage brokers and agents within our network, as well as consumer reporting agencies, credit bureaus, financial institutions and real estate appraisers. Obtained personal information could include the following elements: your name, your address, your email address, your financial information, your credit history, and other information that is relevant to the products and services we offer, whether relevant to a mortgage loan application or are included in an inquiry sent by you, whether directly or through one of the mortgage brokers or agents in our network. We limit the collection of your personal information to information we need as explained below or in compliance with what the law requires or allows.

Reasons for Collecting, Using and Disclosing Personal Information

We collect, use, and disclose your personal information in order to:

  • Offer you products and services
  • Process mortgage applications and inquiries you send to us, through one of our firm’s mortgage brokers
  • Facilitate your relationships and transactions with mortgage brokers as well as with users of our products and services
  • Understand your needs and preferences in order to better serve you, notably with respect to recommending products and services that are suited to your specific needs
  • Develop, market and sell or provide our products and services
  • Establish and maintain a business relationship with you, which includes verifying your identity and performing contractual obligations
  • Obtain information about your credit history, in the event you apply for credit or a mortgage
  • Process payments related to your purchase of our products and services
  • Develop, manage and improve our business and our activities
  • Protect us from errors, breach of contract, negligence, fraud and illegal activity
  • Enter into business transactions, including the purchase, sale, lease, merger, amalgamation or any other type of acquisition, divestiture, securitisation of financing, in which we participate or part of our company participates

If we require your personal information for other purposes, we will provide you with the reasons and obtain your consent if the law requires it.

Disclosure of Personal Information

It is our policy not to disclose or sell your personal information without your consent, except as otherwise provided herein or as permitted or required by law. If you send us a mortgage application or inquiry, either directly or through one of our firm’s mortgage brokers, we may disclose your personal information to third parties, such as lenders, insurers, and credit reporting agencies. We may also disclose your personal information to our brokers and their respective affiliates for the purpose of processing your loan request or information. From time to time, we may disclose your personal information to service providers we have hired to perform certain functions on our behalf or to provide services to us, including third party providers of software, payment processing services and web hosting services. We may perform data analytics on your personal information and produce reports, statistics and information using your personal information for publication purposes (but only in anonymized and aggregated form).

Any personal information may also be transferred or disclosed to a buyer or prospective buyer in the event of a sale, assignment or other transfer of all or part of our business or our assets. In the event of such a transfer, we will use all reasonable efforts to attempt to ensure that the recipient of the transfer uses your personal information in a manner consistent with this Privacy Policy.

Job Applications

If you apply for a job with us, we will use the personal information we collect in connection with your job application to assess your application and decide whether to offer you a position. If you accept a position with us, personal information will be stored in accordance with our privacy policy relating to the personal information of our employees. If we do not offer you a position or if you do not accept our offer of employment, we will retain your personal information for a reasonable period in the event that a suitable position becomes available or in the event that you send us a new job application.

Storage or Processing Facilities

We and our service providers may store or process your personal information in Canada and, to the extent permitted by applicable laws, the United States, or other jurisdictions.
